Police officer captured in video beating suspect to the ground

The reputation of the Royal Barbados Police Force (RBPF) is taking a beating following the advent of a video which has gone viral on social media, showing what appears to be a police officer, brandishing a weapon and literally kicking a man while he is down.

And Attorney General Adriel Brathwaite and Acting Commissioner of Police Tyrone Griffith have been dragged into the heart of the potential scandal, with renowned attorney-at-law Andrew Pilgrim, QC, demanding they both resign unless they deal swiftly with the perpetrators.

Pilgrim, who is representing the man seen in the video, as well as a second alleged victim of police abuse, Monday served notice that legal action will be taken against all the officers within 48 hours – three altogether – involved in the “blatant abuse of power”.

“He [the officer seen kicking the man], but not he alone, all of those that are responsible for this type of behaviour will have to come to a court and say, ‘not guilty’, they didn’t do it, and prove their case,” Pilgrim said.

The man seen being kicked in the video is 26-year-old Dario Rico Stanton of Hart’s Gap, Christ Church, while the other is  22-year-old Romario Mitchell Quintyne of 122 Cordia Drive, Warners Park, Christ Church.

The two emerged from the District ‘A’ Magistrates’ Court Monday to show journalists injuries they allegedly sustained, such as heavy bruises to the face, back, chest, lips, feet and armpit, as well as a bloodshot, black eye and swollen cheeks.

Stanton, a mechanic, pleaded not guilty to assaulting Police Constable Justin Phillips, occasioning him actual body harm, as well as obstructing that officer and Police Constable Bradley Cutting in the execution of their duties, and assaulting his colleague, Police Constable Akeel Grant with intent to prevent the officer from lawfully apprehending him.

Quintyne, meanwhile, denied that he failed to obey a lawful order to keep moving given by Cutting, resisting the officer in the execution of his duties and using abusive language.

The attack came after the RBPF Task Force was called in Sunday night to restore order at the last in the series of Waiki events at Pirate’s Cove, The City.

The popular event has been attracting large crowds since February. However, things got out of control as patrons reportedly broke down the fence in a mad scramble to get into the event.

As result, several people were detained, including Stanton and Quintyne, both of whom, Pilgrim claimed, had gone to pick up their girlfriends and arrived there after the disturbance had started.

“The camera shows blatant abuse of police power. I don’t think there is any other way to describe it,” Pilgrim told reporters.

The Force issued a statement Monday seemingly casting doubt that the man seen abusing Stanton was a police officer.

It said an internal investigation had been ordered into the social media posting “showing an individual dressed in a uniform similar to one worn by members of the Royal Barbados Police Force” kicking the man.

“These investigations will  . . . determine if the individual in the posting is a member of the Royal Barbados Police Force,” the statement said.

However, Pilgrim all but ridiculed the police statement, telling journalists he knew some of the officers in the video, therefore, the RBPF needed little time to identify the offender.

Unless this is done, he said, both Brathwaite and Griffith should stand down.

“With all due respect to the Commissioner of Police it cannot take them more than half an hour to find out if that person is a member of the Royal Barbados Police Force because he is certainly acting in concert with other people I can identify as members of the Royal Barbados Police Force. So even if he is not a member of the Royal Barbados Police Force they need to find out why he is assisting members of the Royal Barbados Police Force, and either way those that are assisting him and whoever he is need to be charged . . .  . So they need to show that they are sinking their teeth into this thing with a level of urgency, failing which one of them would have to go home – the Commissioner of Police or the Attorney General.

“There must be a zero tolerance attitude to that type of behaviour and if the Commissioner has seen the video and acknowledges that a police officer is carrying on in that fashion he should say, ‘I am going to investigate this immediately, suspend all parties who are there and are complicit in it’, and if he does not do that he should resign forthwith. He and the Attorney General, both of them should resign if they are allowing this to happen and not treat it with zero tolerance,” Pilgrim said.

Social activist and attorney-at-law David Comissiong had earlier advised the two men to sue the officers.

Like Pilgrim, Comissiong complained that police abuse was much too prevalent here and the Force ought not be allowed to get away with it.

“We the Barbadian society need to respond by not permitting any impunity. Citizens who are treated unjustly and wrongfully by police officers need to seek counsel from attorneys-at-law and take legal action. That is the only way a strong message will be sent,” he said.

The attorney also called for reform of the Force to make it more accountable to the public, charging that the current system established to probe complaints against officers was not reliable.

“I am not convinced that the Office [of Professional Responsibility] is capable of properly investigating and processing such complaints and bring wrongdoers to justice. I think it is very difficult for the police to investigate themselves and police to charge and discipline other police officers.”

Stanton was released on $8,000 bail while Quintyne secured his $2,000 bail with one surety.

Both men have been warned to stay away from the complainants and to keep the peace.

They are due to return to court on September 14.

    First things first..these men were engaged in a violent affray before the Police arrived. Licks like peas were shared. Men were fighting bad bad bad, sharing nuff blows and holding nuff licks too. So don’t expect people to believe that whunnuh did not receive injuries from the big fight before Police arrived at the scene and now trying to blame the Police for the licks whunnuh hold and now looking fuh money.

What is abusive language charge anyhow? the officer and whoever else should have been suspended or taken off the streets pending an investigation. Attorneys Pilgrim and Comissiong are the only two that will seek justice for the unfortunate, the hundreds of others, they`re are hobnobbing with the so call big fellas hoping for piece of the pie.         @hcaindre. Yes, investigations must be done and no police brutality tolerated. But we ain’t going tolerate lawlessness from these gangsters either. Don’t put demons before the public and try to convince us dem is angels and ain’t do anything wrong. Also, believe it or not, Police are trained to kick suspects for compliance, the same way they are trained to strike people with batons, punch them, give them karate chops, falls etc. Even if the Police were not trained to use kicks, the LAW authorizes them to use force, ANY FORCE, against citizens, once it’s absolutely necessary for a purpose permitted by law, such as an arrest and once it is reasonable and proportionate under the circumstances to achieve the lawful objective. Don’t get tie up, Pilgrim and Comissiong got to come real good to convince a court of law that the small 6-second video footage shows Police brutality.

          @Bajan I get what you’re saying but the man was already on the ground when he was kicked, he was already handcuffed and laying helplessly on the ground. There’s nothing you could say to justify that. I’m not by any means saying that the cops had no right to detain then but there’s no way they should be allowed to kick someone who’s already down. I pray nothing like this ever happens to a member of your family because I don’t think you’d be saying the same thing if u were to see one of your loved ones laying there being kicked like that… I don’t believe all injuries were done by the police and I do believe they probably were resisting but if u already have the man detained and he’s on the ground why kick him??

      When the organizers of these events hold these events if i was the police they would have to get their own security. Those who are critical of the police have no idea what the police have to face, quite recently i saw some very disturbing material posted on social media with thugs displaying their weaponry, has anyone from the media investigate the veracity of those postings? Yet there are parading this event, in my opinion if the police is to be constantly ridiculed by the anti police elements in society i say this, the only intervention the police should make at these events which always breeds this behavior is when a crime scene management unit is required and those who are wise would understand what i mean. it as fact that the two most stressful jobs in the world are those of the police officer and an air traffic controller. I am sick and tired of the way society is, if these hooligans would go to these events and behave themselves incidents like these would be nonexistent. On another note there are certain attorneys in the country that once you acquire their services it requires money and a lot of money, i often wonder how certain ones are acquired so quickly especially when it comes to matters involving the police? I wonder if there is a pattern here? It is amazing how some people are always ready to bash the police when it is a matter that does not involve them, yet if they find themselves in any circumstance where they need the police the opinions of the police change even if it is only for the usual very short time.

    I think it is ridiculous how our society thinks is ok that a police officer can do this to another individual and nothing comes of it. No one deserves to be kicked and to make matters worse , he was on the ground detained ,Head between the officer legs and arm held down. So for that officer (or person that is “assisting” the police as they try to portray it) to come over and do what he did was a blatant case of Police brutality . As for the persons that think that the police was in the right here you should ask yourself if this was your brother or son would you feel the same way.

    I would like to see the full video before the task force arrived.These wannabe bad boys do a lot of nonsense,one recently got in a ZR and shot another without regard for others in that van.Some of them ride motor cycles doing wheelies and going through red lights.//I am not condoning police brutality against anyone but there is too much disrespect for the police in Barbados and those Task Force officers are serious people if they tell to move along ,just do so and leave out the attitude.Nowadays the teachers can not lash students,no one is being punished by hanging therefore there is a total breakdown in discipline in this country and you have to be tough with some of these thugs therefore let me see the full video to judge.

      The Superintendent of police that you spoke should have known not to entertain you. He obviously whoever he is certainly breached protocol especially since he was just viewing a video you sent. I get the impression that he does not even know you that well, or maybe he viewed you as a confidential person which you obviously are not, but it serves right that you have literally exposed him in this forum. I wonder if he attended the training school? Sounds like a rookie to me.

    What stands out here for me is that had not for Andrew Pilgrim and David Commission, going after justice for these kinds of acts by the police, because it is our police, would be futile…

    It seems like most of the masses believe that a police officer has this right to draw his weapon whenever and wherever he chooses and also that they have all rights to beat up on someone just because they are perceived as a criminal, gangster or a perpetrator of a crime, well you masses are wrong…

    Until the RBPF get their act together, hundreds of thousands of your tax dollars will be paid out to victims of police brutality because police officers are not a law unto themselves…

      These police officers need training and a lot of it as well, this is not the first time something like this occurred in Barbados, the last publicly known time that this happened a pastor, no less got a bullet in his head from a cop that didn’t have the sense to know that you don’t brandish a firearm in a crowd. Basic firearm safety handling would have taught that.
      Next, although we’ve been led to believe this from childhood, don’t get carried away with that utopian way of thinking that the police are there to protect you the individual, their main job is to protect the State not you, period !!!

      As far as I know the revolver is what was taken from the guy on the ground. He pulled his gun on the police after refusing to leave the car park & was taken down.

      I have friends in the force and they say bajan’s only video after the altercation that caused the officer to retaliate, so when we see a video before the kicking happen, then we could judge, as far as I see, the officer trying to do their job

    Hold on… the incident started because the promoters & security decided the venue was at capacity & closed the door.

    People outside then decided to push down the fence to get inside.. get inside to go where ???

    The security, unable to handle this crowd & probably the people who were hurt when that fence came down, called the police.
    The police realized they too will need assistance.
    They called the Task Force.. let that sink in… The TASK FORCE needed to be called because that crowd of “young people” was so rowdy and violent.

    As far as I know the man on the ground pulled a gun on said Task Force officers, this is after refusing their orders to leave the car park, this is after he & a group of men cursed & threatened them.. he pulled a GUN! The officers managed to take him down he was still fighting & carrying on.
    I’m not saying the kick was the best course of action but look at everything surrounding it!!

    This man left home with a GUN to go to a FETE!!!
    Disrespected the venue, the security, the Police & the task force with his actions & wunna vex bout a kick????

    There was a time that the Police turning up was enough to make people leave, these people cursed the police & refused to leave, lean up & sit on people’s cars – wunna think they care about any damage???
    walked all bout the road, blocked up traffic, whole time cursing & carrying on.

    Wunna need to get ALL the information before making statements.

    And yes I was at this event & saw this shit happen live!

    Heavy bruises to the face, back, chest, lips, feet and armpit, as well as a bloodshot, black eye and swollen cheeks.

    Did they tell the journalists what percentage of those injuries was inflicted before the police arrived and what percentage was inflicted by the police?

    Lest we forget, Pilgrim and Commissiong wouldn’t be the only lawyers in court. The Police will have legal representation also. The owner of the business place and his staff will also be in court.

    Easy man, they are only tarnishing the exceptional reputation of the other law abiding, and public serving police officers.

    These types must not be supported, but must be purged from the system. I know it takes time, and gathering of evidence, but start with the officer in charge of the unit, and the officer in charge of the shift on Sunday. Let them provide credible reports of the circumstances or, be placed on suspension so another selected senior officer can investigate. The officers in the video should be placed on suspension, but obviously this will only happen if and when the lawyers for those assaulted brings a criminal complaint against the officers. So rather than Pilgrim talking so much, and whipping up the public, he should be pressing on with bringing charges against the officers.

    Sadly, the silly season has surfaced here too, he too is calling for the resignation of the acting Commissioner of Police, and the Attorney General as if they were there. Take your clients to the police station with medical certificates, and copies of any video evidence and have the officers you claim you can identify charged. It’s that simple. Stop using the suffering members of the public for your political agendas.

I know… budget restraints and all.. and the likelihood of them not being turned on or being maintained is also an issue… But I would think that they would find them useful in documenting their lawful arrests… and quell any discussions like this.. or get them reprimanded if they strayed from the law they are sworn to uphold…. They are servants of the state after all ….. and as such must own up for their actions to the state… whether good or bad…

They were summoned to Pirates Cove to restore order after a group of hooligans endangered the lives of innocent patrons. Do you believe that the accused will produce video showing that they were innocent bystanders, cooperating with police and not assaulting the police? There is nothing called humane treatment for hooligans fighting among themselves and against the police.

    Who is to blame in this situation? For sure not the ones who were abuse by policemen. A police officer must possess the necessary characteristics and skills to de-escalate altercations. They must possess strong moral values and have the ability to thing strategically when faced with ethical dilemmas. These officers are not fit for duty, their ability to do their job have been compromise.

    Some officers seem to conduct themselves in an angry manner, when dealing with the public, especially, individuals liming in the ghetto. Therefore, special training have to be implemented, ect safe management, de-escalation techniques. On the other hand, kicking someone and brandishing a weapon is an abuse of power.

    Being a police officer is much more than just having authority and power over people. It is about connecting with the public and ascertaining what gaps are not being met. Also, collaborating with social services to combat various problems in society is important.

    In Social Services workers can become compassionate fatigue Indeed, the same can also happen to officers. Where they lose the real purpose for what an officers really means to the Barbadian society.

    I personally can attest to the crappie that the police do , they shoot my son whilst they had him on the ground lying on his belly the bullet entered from the back and to justify what they did they got he in prison for a gun they say that he pelt way .     I would like to say the only protection we have is the Royal Barbados Police Force and whatever measures need to be taken should be taken against some of those house breaking, marijuana smoking, delinquent young men. These days it is very difficult to walk the streets and enjoy beautiful Barbados without being harrassed. Keep up the good work police. If they can’t obey they will get the boot. Take whatever measures you need to. You have families also and you risk your lives daily for us. Thanks to you. Some people will not like the results but press on.

Do you not see the Police walking pass people on the ground, and kicking this person twice ? what planet are you living on, you think that making this statement does something for you ? Yes it does, it shows that you are a law breaker.

      I know a lot you think that by siding with folly because it is the Police that it is patriotic. Cherry, I have news for you, you condone this action, you are a law breaker, you have been a law breaker, you have broken the law, and you will continue to break the law, but, you will be caught.

    Who cares what the men were allegedly doing before the incident with the police, the fact of the matter is that the man/men were restrained on the ground in hand cuffs and a big gullybore come through and ring some kicks in the man/men. Stupse, then the same police want to know why persons don’t come forward with information.

    Sadly we see so many anti police comments which is an indication of the attitude these people have to our police officers. Wonder if Sinckler had imposed more taxes or LOW had allow the garbage to pile up even more and buy BMW instead od garbage trucks or Boyce who allows the elevators at the QEH to remain out of order for 3 months and their grand parents got to struggle to get upstairs on the wards or Jones had crack a head or Mara did curse their adopted mother or Blackett had cause their blood to flow in the gutter or Freundel did contine to negatively impact this country and then call them nipple suckers if we would see all of these these comment.

    Many of us have love ones on the Police Force, so many of us are aware and, know the dangers of the job. We know that all Police, people period for that matter, are not all the same, so we have no problems with those upstanding Policemen and Women. ROGUE POLICE, that is another matter all together.

    Betty Charles, Sharon Taylor, She-lock Holmes, and those who share the same view as you. You guys need to return to the cane piece, sorry, the jungle and live. Wait, not the JUNGLE, even the animals there have more intelligence than you.
