Two walk after witnesses fail to testify

courtDay two of an actual bodily harm trial involving two men took an unexpected turn in the No. 5 Supreme Court today.

Principal Crown Counsel Elwood Watts reported that two critical witnesses in the case against Terrell Tarior Mayers, also known as Spuzzy of Phillips Road, Cleavers Hill, St Joseph, and Ryan Omar Samuel, alias Rusty, of Grape Hall, St Lucy, were no longer willing to give evidence in the matter.

And Madam Justice Jacqueline Cornelius had no choice but to direct the nine-member jury to return a not guilty verdict against the two who were charged with causing actual bodily harm to the late Rico Depeiza of Checker Hall, St Lucy on May 21, 2011.

Yesterday, three police officers gave evidence in the case.

Mayers and Samuel and four other men – Benson Finisterre, Ryan Anderson Moore, Kaeron Sylvan Moore and Dwayne Decarlo Griffith – were originally charged with Depieza’s

However, that case was discontinued and they were subsequently charged for causing Depeiza actual bodily harm.

    Fear is probably the reason why these two witnesses decided they didn’t want to testify. When this happens it empowers the accused . It allows them to feel invincible . It makes Police look stupid. It allows these criminals to go unpunished because in their minds they can do anything they want to because witnesses are afraid of what will happen to them or their families if they testify.
    When this type of a president is allowed to go unchecked ,we are actually giving the criminals a green light to do whatsoever they want to do without punishment. We are going to see much more of this because we have given the all clear.
