Cox remanded

A 19-year-old man has been charged with the murder of Veldene Hinds.

He is Rasheed Sylvester Cox, of Ocean Road, Deacons Farm, St Michael.

Hinds, 57, of Carrington Village, St Michael was shot in the head while being driven along Barbarees Hill, St Michael on May 1.

She succumbed to her injuries four days later at the Queen Elizabeth Hospital.

The murder accused is also facing three other charges- wounding with intent, the use of a firearm and unlawful sexual intercourse.

Cox appeared in the District ‘A’ Magistrates Court today and was remanded to jail.

    How is this teenager charged with murder when the woman wasn’t the intended target? Murder involves some form of premeditation and the designed intent to take another human being life unlawfully. In this young man case he unlawfully took the life of this woman while she was a passenger in a car driven by other, but she wasn’t his intended target, so therefore, the mental element (mens rea) for murder wasn’t present when he committed this unlawful killing. So how could he be charged for murder? Some lawyer would have to shed clearer light on this one because I don’t get it. Remember now, a conviction of murder carriers the death penalty in some countries.

      A person cannot be charged with anything; don’t know where you have gotten that notion from. Before a person is charged the district attorney/ prosecutor or whatever yall call him or her in Barbados, makes the determination based on the investigatory facts of the case, if such charge will stand up under scrutiny in a court of law.

      He intended to kill, just because this piece of scum shot the wrong person, why should he get a lesser sentence ? The courts are a total joke in Barbados, youths have no fear when they commit any crime, most smile and wave when they leave court, even when they have murdered

      Intended to kill who is more of the question Sharon Woolley? He held no malice against the woman he killed and probably never met her in his entire life. Now if he had shot and killed the person he was shooting at, then he may caught a murder charge.

      He set out to kill, because he’s such a moron he killed an innocent woman, but he still set out to kill so it was premeditated. Which means murder.If this was to go through as manslaughter every person who murders can say, “I got the wrong person, I didn’t mean it to be them”

        MURDER: “The killing of another person without justification or excuse, especially the crime of killing a person with malice aforethought or with recklessness manifesting extreme indifference to the value of human life”.

        In this particular case, the correct charge was brought.

        A robbery with the use of a firearm was in progress. It matters not whether the person killed was the intended victim.

    Mr Fenty, I can tell that you were a good student in Law School. Maybe you are now a Q C? Permit me to ask you a question please: What game do you believe he had decided that he was going to play before he had armed himself with the gun? If you were the victim (now deceased) in that car, do you think your lawyer and family members would have argued (at a later date) in the Courts with your said “legal facts”? Maybe the accused person’s family would seek you out eventually to thoroughly represent him. What say you?

      Observer, I do not think Mark Fenty knows what he is talking about.

      A charge of murder can be brought against the perpetrator even if the person killed was not the intended victim.
