Dead man ‘walks’ free

COURT TODAY BLOCKHe was one of two people charged with causing serious bodily harm to Akeem Forde with intent to maim, disfigure or disable him on October 26, 2012.

However, yesterday Magistrate Douglas Frederick was left with no other choice but to throw out the case brought against Kemar Whitfield Leacock.

“The matter against him is obviously dismissed because you cannot prosecute a dead man,” the magistrate said after Leacock’s mother presented his death certificate to the District ‘A’ Magistrates’ Court.

Leacock, formerly of 7th Avenue New Orleans, St Michael, was charged, along with Marvin Marcus Victor, with causing serious bodily harm to Akeem Forde with intent to maim, disfigure or disable him on October 26, 2012.

Leacock died on August 14, 2015.

    Things like this is making a mockery of our Justice system.

    How could they not have known that he had died? This reminds me of a case of the Police executing a search warrant in Halls Road looking for a dead man.

    Mr. Cadogan, how were they have known he had died? Does the court eavesdrop or spy on Barbadian citizens to know people’s private business? Even if the prosecutor or Judge/Magistrate had heard or read in the news that he had died the case still has to go through the official notification process.

    It is just a formality through the system Mr Bright Boy.Maybe some one who has a legal certificate from UK or the Region could have told you so.
