Case against elderly man dropped

todays courtA 74-year-old man accused of indecently assaulting an eight-year-old girl walked out of the High Court today without the charge hanging over his head.

Justice Olson Alleyne ruled that George Henry Brathwaite did not have a case to answer, upholding a no-case submission made by defence attorney Debra Gooding.

The retiree, who resides at Lowthers Hill, Christ Church, had been accused of committing the offence on January 10, 2013.

The defence lawyer began her submissions yesterday and continued this morning, following which the judge delivered his ruling.

Prior to the no-case submission, four witnesses testified for the prosecution led by Crown Counsel Krystal Delaney, and the girl’s evidence was given in camera.

The case was heard before a jury of eight women and one man.
